Terms of Use
DarkRoom · Last updated October 5, 2026 · Effective October 5, 2026
These Terms of Use ("Terms") are a legal agreement between you and CarbonCode ("we," "us," "our"), operated by Tomas Ramirez as a sole proprietor, governing your use of the DarkRoom app for iPhone and Apple Watch (the "App"). By downloading, installing or using DarkRoom, you agree to these Terms. If you do not agree, do not use the App.
1. The App
DarkRoom is a calculation aid for gamma radiographic testing with Iridium-192 and Cobalt-60 sources. It estimates shot times, source decay, boundary distances, geometric unsharpness and related values from published formulas and the values you enter, and it shows plain-language summaries of acceptance limits from industry codes.
2. Professional use and safety
DarkRoom is intended for qualified radiographic testing personnel. It does not replace your training, your employer's written procedures, your radiation safety program, or the judgment of a qualified Level II or Level III.
Every result is an estimate. You are responsible for checking each result against your procedure and a known shot before you rely on it, and for confirming every boundary and barricade with a calibrated survey meter. Never use a calculated distance in place of a survey.
The code summaries in the App are not the codes. The governing code edition, the contract and your written procedure always control. You are responsible for meeting every regulatory and licensing requirement that applies to your work.
3. Eligibility
You must be at least 18 years old to use the App. You need an iPhone running iOS 17 or later. The Apple Watch app is optional.
4. License
We grant you a personal, limited, non-transferable, revocable, non-exclusive license to install and use DarkRoom on Apple devices you own or control, subject to these Terms and Apple's Licensed Application End User License Agreement ("Apple EULA"). The Apple EULA is incorporated by reference and, in the event of conflict with these Terms, these Terms prevail except where the Apple EULA protects end users more strongly.
5. Purchases
If DarkRoom offers in-app purchases, Apple processes them through the App Store, and Apple's terms govern payment and refunds. Request refunds from Apple at reportaproblem.apple.com.
6. Acceptable use
You agree not to:
- Reverse-engineer, decompile, or attempt to extract source code from the App except as permitted by law.
- Use the App for unlawful purposes.
- Circumvent or interfere with any purchase gating in the App.
7. Intellectual property
The App, including its code, design and layout, is the property of CarbonCode and protected by applicable intellectual property laws. API 1104, ASME B31.3, ASME Section V and AWS D1.1 are standards published by the American Petroleum Institute, ASME and the American Welding Society. Their names identify the standards the App summarizes. DarkRoom is not affiliated with or endorsed by those organizations, and it does not reproduce their standards.
8. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT ANY CALCULATED SHOT TIME, DISTANCE, LIMIT OR OTHER RESULT IS ACCURATE, COMPLETE OR SUITABLE FOR YOUR WORK.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARBONCODE AND TOMAS RAMIREZ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, PROPERTY, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE APP OR RELIANCE ON ITS RESULTS. OUR AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) USD $25.
Nothing in these Terms limits liability that cannot be limited under applicable law (including consumer protection laws in your jurisdiction).
10. Indemnification
You agree to indemnify and hold harmless CarbonCode and Tomas Ramirez from any claims, damages, or expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the App or its results.
11. Third-party beneficiary
Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you. You acknowledge that Apple has no obligation to provide maintenance or support services for the App.
12. Termination
We may suspend or terminate your access to the App at any time, with or without notice, for any breach of these Terms. You may stop using the App at any time by deleting it. Sections that by their nature should survive termination (including Sections 2, 8, 9, 10, 13, and 14) will continue to apply.
13. Governing law and disputes
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-laws principles. Any dispute arising from these Terms or the App shall be brought exclusively in the state or federal courts located in Texas, and you consent to personal jurisdiction there. Nothing in this section deprives you of any mandatory consumer-protection rights in your country of residence.
14. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Continued use of the App after an update constitutes acceptance of the revised Terms.
