Terms of Use

These Terms of Use ("Terms") are a legal agreement between you and CarbonCode ("we," "us," "our"), operated by Tomas Ramirez as a sole proprietor, governing your use of the UTCal mobile application (the "App"). By downloading, installing, or using UTCal, you agree to these Terms. If you do not agree, do not use the App.

1. The App

UTCal is a calibration calculation tool for non-destructive testing (NDT) inspectors. It performs ultrasonic and PAUT calibration calculations and provides reference data to assist qualified inspectors in the field. The App is a calculation aid — it does not replace the judgment of a certified inspector, calibrated equipment, or applicable codes and standards.

2. Eligibility

You must be at least 13 years old (or the minimum digital consent age in your country, whichever is higher) to use the App.

3. License

We grant you a personal, limited, non-transferable, revocable, non-exclusive license to install and use UTCal on Apple devices you own or control, subject to these Terms and Apple's Licensed Application End User License Agreement ("Apple EULA"). The Apple EULA is incorporated by reference and, in the event of conflict with these Terms, these Terms prevail except where the Apple EULA protects end users more strongly.

4. UTCal Pro — one-time purchase

4.1 What Pro unlocks

Pro features are displayed within the App and may be updated from time to time. The current feature set is shown on the App's product page and within the App itself.

4.2 Payment

All purchases are processed by Apple via the App Store and billed to your Apple ID. CarbonCode does not receive or store your payment information.

4.3 Restoring purchases

To restore a Pro purchase on a new device or after reinstalling the App, use the Restore Purchases option within the App. You must be signed in with the same Apple ID used for the original purchase.

4.4 Refunds

All purchases are final and non-refundable except where required by law or at Apple's discretion. Refund requests must be submitted to Apple via reportaproblem.apple.com. CarbonCode cannot issue refunds directly.

4.5 Changes to pricing

The price of UTCal Pro may change over time. Changes apply only to future purchases and do not affect purchases already made.

5. Professional disclaimer

UTCal is a calculation aid for use by qualified NDT personnel. Results produced by the App must be verified by a competent, certified inspector before use in any inspection, acceptance decision, or safety-critical application. UTCal is not a substitute for:

• Calibrated and certified inspection equipment.
• Applicable codes, standards, and written inspection procedures (e.g., ASME, API, AWS, ASTM).
• The professional judgment of a Level II or Level III certified inspector.

Do not rely on the App as the sole basis for any accept/reject decision on safety-critical components.

6. Acceptable use

You agree not to:

• Reverse-engineer, decompile, or attempt to extract source code from the App except as permitted by law.
• Use the App for unlawful purposes or in violation of applicable codes and standards.
• Circumvent or interfere with the Pro purchase gating.
• Misrepresent the App's results as a substitute for certified equipment or qualified personnel.

7. Intellectual property

The App, including its code, design, calculations, and reference data, is the property of CarbonCode and protected by applicable intellectual property laws. Code references and acceptance criteria reproduced in the App are used for informational purposes consistent with fair use; they remain the property of their respective standards bodies.

8. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR FITNESS FOR USE IN SAFETY-CRITICAL APPLICATIONS. WE DO NOT WARRANT THAT CALCULATION RESULTS WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR ANY SPECIFIC INSPECTION SCENARIO.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARBONCODE AND TOMAS RAMIREZ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, PROPERTY, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE APP OR RELIANCE ON ITS RESULTS. OUR AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) USD $25.

Nothing in these Terms limits liability that cannot be limited under applicable law (including consumer protection laws in your jurisdiction).

10. Indemnification

You agree to indemnify and hold harmless CarbonCode and Tomas Ramirez from any claims, damages, or expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the App or its results.

11. Third-party beneficiary

Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you. You acknowledge that Apple has no obligation to provide maintenance or support services for the App.

12. Termination

We may suspend or terminate your access to the App at any time, with or without notice, for any breach of these Terms. You may stop using the App at any time by uninstalling it. Sections that by their nature should survive termination (including Sections 8, 9, 10, 13, and 14) will continue to apply.

13. Governing law and disputes

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-laws principles. Any dispute arising from these Terms or the App shall be brought exclusively in the state or federal courts located in Texas, and you consent to personal jurisdiction there. Nothing in this section deprives you of any mandatory consumer-protection rights in your country of residence.

14. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Continued use of the App after an update constitutes acceptance of the revised Terms.
