Terms of Use

These Terms of Use ("Terms") are a legal agreement between you and CarbonCode ("we," "us," "our"), operated by Tomas Ramirez as a sole proprietor, governing your use of the FormulaPulse mobile application (the "App"). By downloading, installing, or using FormulaPulse, you agree to these Terms. If you do not agree, do not use the App.

1. Independence and non-affiliation

FormulaPulse is an independent, unofficial Formula 1 companion app. It is not affiliated with, endorsed by, sponsored by, or approved by Formula 1, the FIA, Liberty Media, any Formula 1 team, driver, circuit, broadcaster, or rights-holder. All trademarks, team names, driver names, and imagery remain the property of their respective owners.

2. Eligibility

You must be at least 13 years old (or the minimum digital consent age in your country, whichever is higher) to use the App. If you are under 18, you must have the permission of a parent or legal guardian.

3. License

We grant you a personal, limited, non-transferable, revocable, non-exclusive license to install and use FormulaPulse on Apple devices you own or control, subject to these Terms and Apple's Licensed Application End User License Agreement ("Apple EULA"). The Apple EULA is incorporated by reference and, in the event of conflict with these Terms, these Terms prevail except where the Apple EULA protects end users more strongly.

4. FormulaPulse Pro subscription

4.1 What Pro unlocks

• Race Replay (full session replays after each Grand Prix).
• AI Article Summary (on-demand summarization of news stories).
• Past Race Detail (results, podium, and analysis for prior rounds).
• Saving and offline downloads for news stories.
• Access to FormulaPulse on Apple Watch.
• Ad-free experience.

4.2 Free trial

The yearly plan includes a 7-day free trial available only to first-time subscribers, as permitted by Apple's rules on introductory offers. If you have previously subscribed to FormulaPulse Pro (monthly or yearly) and are re-subscribing, the trial is not available.

You will not be charged during the trial. If you do not cancel at least 24 hours before the trial ends, your subscription will automatically convert to a paid yearly subscription and your Apple ID will be charged $24.99 (or local equivalent).

4.3 Auto-renewal

Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the end of the current period. Your Apple ID will be charged the renewal price within 24 hours prior to the end of the current period. You can manage and cancel subscriptions in:

iOS Settings → [your name] → Subscriptions → FormulaPulse.

4.4 Payment

All subscription purchases are processed by Apple via the App Store and billed to your Apple ID. CarbonCode does not receive or store your payment information.

4.5 Changes to pricing

We may change subscription prices. If we increase the price, Apple will notify you before the change takes effect and ask for your consent where required. If you do not consent, your subscription will not renew at the new price.

4.6 Refunds

All subscription purchases are final and non-refundable once a billing period begins, except where required by law or at Apple's discretion. Refund requests must be submitted to Apple via reportaproblem.apple.com. CarbonCode cannot issue refunds directly.

4.7 Restoring purchases

To restore an existing subscription on a new device or after reinstalling the App, open Settings → Restore Purchases inside the App. You must be signed in with the same Apple ID used for the original purchase.

5. Content and data

FormulaPulse displays Formula 1 data (schedules, results, standings, driver and team information) aggregated from public sources, and news headlines and thumbnails from public RSS feeds of third-party outlets. Tapping a headline opens the original publisher's website. We do not republish full article content and are not responsible for third-party content.

Live session data, schedules, and results are provided on a best-effort basis and may be delayed, incomplete, or inaccurate. FormulaPulse is not a source of official timing or scoring. Do not rely on the App for wagering, commercial, or regulatory decisions.

6. Acceptable use

You agree not to:

• Reverse-engineer, decompile, or attempt to extract source code from the App except as permitted by law.
• Use the App to scrape, mirror, or republish third-party content accessed through it.
• Interfere with or circumvent subscription gating, ad serving, or consent flows.
• Use the App for unlawful purposes.
• Misrepresent your identity or attempt to gain unauthorized access to our systems.

7. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF DATA. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DATA WILL BE ACCURATE OR COMPLETE.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARBONCODE AND TOMAS RAMIREZ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE APP. OUR AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) USD $25.

Nothing in these Terms limits liability that cannot be limited under applicable law (including consumer protection laws in your jurisdiction).

9. Indemnification

You agree to indemnify and hold harmless CarbonCode and Tomas Ramirez from any claims, damages, or expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the App.

10. Third-party beneficiary

Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you. You acknowledge that Apple has no obligation to provide maintenance or support services for the App.

11. Termination

We may suspend or terminate your access to the App at any time, with or without notice, for any breach of these Terms. You may stop using the App at any time by uninstalling it. Sections that by their nature should survive termination (including Sections 7, 8, 9, 12, and 13) will continue to apply.

12. Governing law and disputes

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-laws principles. Any dispute arising from these Terms or the App shall be brought exclusively in the state or federal courts located in Texas, and you consent to personal jurisdiction there. Nothing in this section deprives you of any mandatory consumer-protection rights in your country of residence.

13. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Material changes will be announced in the App. Continued use of the App after an update constitutes acceptance of the revised Terms.
